Please read these Terms of Service ("Terms") carefully before using the ProMetabolic mobile application operated by Charles Skeggs ("we", "our", or "us"). By accessing or using ProMetabolic, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the ProMetabolic app, you confirm that you are at least 13 years of age and agree to these Terms. If you do not agree to these Terms, please do not use the app.

2. Description of Service

ProMetabolic is a wellness application providing information about pro-metabolic nutrition, an AI-powered coaching feature, food ratings, meal planning, recipe content, and basal body temperature tracking. The app is available as a free tier and a paid Pro subscription.

3. Subscriptions and Payments

ProMetabolic offers a Pro subscription with auto-renewal on a monthly basis. The following applies to all subscriptions:

Subscription title: ProMetabolic Pro
Length: 1 month, auto-renewing
Price: Displayed at the point of purchase in your local currency
Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
You can manage and cancel your subscription at any time via your Apple ID account settings
No refunds are provided for partial subscription periods

All payments are processed by Apple's in-app purchase system. We never see or store your payment card details.

4. Apple Standard EULA

This app is licensed to you under Apple's Standard End User License Agreement (EULA). You can review the Apple Standard EULA at: apple.com/legal/internet-services/itunes/dev/stdeula/

5. Not Medical Advice

The content provided in ProMetabolic — including AI coach responses, food ratings, meal plans, recipes, and tips — is for educational and informational purposes only. It does not constitute medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before making changes to your diet or health routine, especially if you have an existing medical condition. ProMetabolic is not responsible for any health decisions made based on content within the app.

6. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Please notify us immediately at hello@prometabolic.io if you suspect any unauthorised use of your account.

7. Account Deletion

You may delete your account at any time directly within the app via Settings → Delete Account. Upon deletion, all your personal data — including conversation history, food checks, temperature logs, and saved recipes — will be permanently removed within 30 days. You can also request account deletion by emailing hello@prometabolic.io.

8. Acceptable Use

You agree not to:

Use the app for any unlawful purpose
Attempt to reverse engineer, copy, or resell any part of the service
Abuse the AI coaching feature with content that is harmful, offensive, or violates third-party rights
Attempt to circumvent any usage limits or subscription checks

9. Intellectual Property

All content within the ProMetabolic app — including text, design, code, and branding — is owned by or licensed to Charles Skeggs / ProMetabolic. You may not reproduce, distribute, or create derivative works without express written permission.

10. Disclaimer of Warranties

ProMetabolic is provided "as is" without warranties of any kind. We do not guarantee that the app will be uninterrupted, error-free, or completely secure. We reserve the right to modify or discontinue features at any time.

11. Limitation of Liability

To the fullest extent permitted by law, ProMetabolic and its owner shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or email. Continued use of the app after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
